Advice from Gill

Getting compensation is not easy. It is a complicated matter and I am not qualified to advise, except to say “Get advice from a professional”. It may not cost you anything, though this is not guaranteed.

If your property is directly affected by the new road you may be able to claim some compensation.
Ÿ
If your property is not directly affected you may still be able to make a 'Part 1' claim, but not until 12 months after the road has opened.
Ÿ
If you are not eligible to make a claim straight away but think you may want to make a Part 1 Claim later, it is a good idea to start assembling evidence now.
Ÿ
Philip Hodgkin and Graeme Biffen of Greenslade Taylor Hunt (GTH), at our meeting on 2 October 2019, advised getting 2 or 3 valuations on your property from different estate agents now. You should not have to pay for this and you should ask for current valuations to be made on the basis that the new road had not been planned ('unaffected value'), and you should get them in writing.

This exercise should be repeated during and after the build process.
Ÿ
If you want to know whether you may be eligible for compensation, ask a professional. An initial chat with a professional should not cost you anything.
Ÿ
If you find you can make a claim for compensation, you should get a professional to do it for you.
Ÿ
Reasonable professional fees should be paid by Highways England, however, getting them to agree to this is not straightforward, either. Best to try and clarify this before you commit.

I can only tell you what GTH advised. Other Valuers / Estate Agents will also be able to help but I have not spoken to any of them.

Although you may think this is the final design, I was assured at my meeting with Highways yesterday (21 October) that refinements can be made following feedback from residents and landowners. I’m not sure I believe it, but it’s worth a try, isn’t it?

There are so many documents now available that I am having difficulty finding things I know I’ve seen, and can’t recommend any particular ones because different topics will be of interest to different people.

And the secret information (another note from Gill): this page is so hard to find I seriously think they ARE keeping it a secret. To get to it you have to go to the virtual exhibition, click on ‘List view’, then type ‘Figure’ in the search box. Who would think of doing that? Be patient - it takes a while for the file names to show, then you get a cookies choice. There are an awful lot of documents (pdf drawings) on that page, though - I counted 171. And if you download anything and go back to the page, there may be a delay and yet another ‘accept or decline cookies’ choice, which is very annoying. Nevertheless, there is plenty of interest to us there, encompassing noise, flooding and trees for example. At least they are keeping ‘our’ oak tree. If you get a message saying ‘Failed to load pdf file’ you have to click the download arrow to see it, though it doesn’t download to your PC until you click the next download arrow and choose a file name. Feedback forms
Finding the online feedback form seemed to require a lot of clicks so here is a direct link to it: https://highwaysengland.citizenspace.com/he/a358-taunton-to-southfields-2021consultation/consultation/intro/. If you prefer to print out the feedback form, here’s the pdf (though it will use up a lot of your printer’s toner) or you can pick up a hard copy (see below).
Remember, feedback has to be received by 22 November 2021.

Hard copies
You can request a hard copy of the consultation booklet, the Preliminary Environmental Information Report and the feedback questionnaire at one of the face-to-face events or from various ‘deposit points’, including Henlade Post Office, Taunton Library, Blackbrook Leisure Centre and Somerset West and  Taunton Council at The Deane House. Here’s the full list of deposit points. You can also request they be sent to you by emailing A358TauntontoSouthfields@highwaysengland.co.uk or by calling 0300 123 5000 (good luck!).

Land Interest Questionnaires (LIQs)

Highways have been clumsy, to say the least, in the way these were sent out to residents. It is probably a good idea to complete the questionnaire if it definitely relates to your own property. This will ensure that Highways deal with the right people in relation to any particular property. However, if you have any  “rights, easements or other legal interests” over a neighbouring property, or if they have any over yours, you may also have received LIQs for their property. Answer these if you want to and if you feel competent to, but do not feel any obligation to do so.

Stoke St Mary Parish

There is also an alarmingly large swathe of land SWTI&O-047 on Page 21 of Appendix 2 designated “East of M5 (Stoke St Mary)”. Click on the map on the left. On Page 4 of Appendix 2 (link above) the promoted use of this area is given as “New Community”.

A303 Stonehenge - updated 1 May 2017

A303 Stonehenge - updated 21 October 2021

This scheme is now on hold following the High Court Judge’s upholding of the legal challenge against it in August 2021.

The links below are still active so they are left here for reference.

The A303 Stonehenge (Amesbury to Berwick Down) scheme was given consent by the Secretary of State Grant Schapps on 12 November 2020.

Not directly affecting us, but this is one part of ‘Creating an Expressway to the South West’ and the dualling of the A358 is another.

Nexus 25 - M5 Junction 25 Employment site
The site will be developed over time and could eventually include a school, a hotel and health centre, as well as providing office space and being home to an innovation hub for businesses.

The Local Development Order (LDO) for this employment site was adopted on 14 March 2018 following grant of planning permission for the M5 Junction 25 improvements.

Click here for Taunton Deane’s (now Somerset West and Taunton’s) statement on the subject.

It will be accessed via a spur road from the new Junction 25 (see above) and the target date for starting on site is Spring 2021.

In the Village Hall newsletter for September 2017, Ruishton Parish Council give a very informative overview and list their objections, which you can see here.

There was an online information page which included the LDO Transport Appraisal Report and Nexus 25 Framework Travel Plan but the link has been removed as the page is no longer available.
